Chimney swifts are protected by federal law
Chimney swifts build small nests of twigs glued to the inside wall of a chimney. The Migratory Bird Treaty Act protects them. As the U.S. Fish and Wildlife Service explains, the law forbids harassing, injuring or killing the birds, and the same goes for their eggs and nests.
That means an active swift nest stays where it is until the birds leave. We do not sweep, block or cap a chimney with nesting swifts inside. Our role is to confirm what is there and plan the cleaning and cap for after the season.

Timing chimney work around chimney swifts
According to the U.S. Fish and Wildlife Service, chimney swifts arrive in the country in March or April and leave in August or September. The agency suggests having the chimney cleaned between September or October and March or April, while the birds are away.
We plan cleaning and capping inside that window for chimneys with a swift history. Booking the work in fall or winter leaves time to finish before the birds return.
The same guidance suggests using a fireplace only during the part of the year when swifts are away. A fall inspection and sweep fits that timing and has the chimney ready before the cooler months.
Raccoons denning in a chimney
A raccoon may use the smoke shelf or the flue as a den, and in spring it may have young with it. Removing only the adult, or closing the top while the young are inside, leaves animals trapped in the chimney.
Florida's nuisance wildlife rule restricts where a live-captured animal may be released, which is one reason trapping belongs with someone who works within that rule. Once the raccoons are out, our team cleans the chimney, checks the damper and flue for damage and closes the top.
Raccoons can also tear screens and bend dampers while going in and out, so the chimney is checked for that damage before a new cap goes on.
Cleaning the chimney after the animal is out
Nests, feathers, fur and droppings usually remain after an animal leaves. Material left on the smoke shelf or in the flue can block the path of the smoke and catch fire the next time the fireplace is used.
Once the chimney is confirmed clear of animals, our team sweeps the flue and smoke chamber, clears the smoke shelf and checks that the flue is open from the damper to the top. You hear what we found before the fireplace goes back into use.
